What changed
ESMA published an opinion setting out supervisory expectations for crypto-asset services involving ARTs and EMTs that do not comply with MiCA. ESMA says CASPs authorised under MiCA should cease providing such services to clients in the EU, across the full range of MiCA crypto-asset services, including trading platforms, exchange, transfers and custody.
Key details
- The opinion asks national supervisors to prevent new or increased client exposure to non-compliant ARTs and EMTs.
- Remaining pre-existing exposures should be remediated within three months of the opinion’s publication.
- Continuing services should be limited to supervised, time-limited activities needed to unwind or safeguard those assets.
What it means
Product perspective: distinguish new payment flows from the handling of existing balances. The opinion’s remediation provisions should be read alongside its restrictions, not treated as general permission to keep offering the tokens.
Matters for
Crypto-asset service providers authorised under MiCA that offer services involving ARTs or EMTs.
